If it's got a motor, any kind of motor, an electric motor, a petrol motor, a motor that runs on cow $hit... it's a motor bike and not a mountain bike.
In case you missed that, mountain bikes do not have a motor of any kind.

An "Off-Road Bicycle" (ORB) is very different to a Motor Bike (MB), but I can see how the term "mountain bike" (MTB) can be blurry.
Anything over 200w is legally regarded as motor bike and needs to be registered and licensed to ride on public land
