Photography Ruling please

The weekend before the Husky 100 I went for a weekend holiday down south and stayed at Culburra Beach. (I probably should have gave warning about the mud).

Not only did I get some fantastic riding in I also took some various photos. I only have an iPhone 4, but it still can take great photos.

At one stage I was on a wharf and managed to walk within a metre of a pelican and got some great photos. Preempting the flight of the pelican I switched to video mode so I could screenshot from the video later. Does this count as a real photo?

I was lucky with that photo. Half a seceond after i took it, 2 fisherman walked past me and unintentionally scared the pelicans off. They were very stealthy. I dont know if they were standing there watching me from behind or not. Didnt here a single foot step.
