Cracked Frame

Hi Guys,
Just after a bit of advice my 09' model scott scale has crack around head set.Now all good in rearguards to replacing the frame but they are not replacing it with a scale frame but same hybrid frame they use for warranty claims.Has anyone had any experience with this situation? Should i not get a same for same replacement?

If it's a SUB frame then you have every right to kick up. They're a great frame (I have a SUB 10) but the geometry is all wrong for off-road use as they have very long chainstays to allow for 700C wheels
I would be surprised. From the NSW office of fair trading – you get to chose the remedy (see below) relating to guarantees. This is not their warranty, but something they have to provide to you by right. They cannot avoid their guarantees in the same way they think they can on a warranty, it is implicate in selling you something. Non negotiable.

Plus their warranty would normally stipulate how the bike has been used, which to my mind cannot be cut both ways. ie when used for purpose and failed they have to replace with something fit for purpose. A hybrid would seem to fail that test unless their hybrid warranty covers MTB… I suspect not – see the loop here?

Can I get a refund, replacement or other compensation?
Whether you get a repair, replacement, refund or other ‘remedy’ depends on whether the problem is:
• major – cannot be fixed or too difficult to fix
• minor – can usually be put right.
You may also be able to claim for compensation for your costs in time and money because something went wrong with the goods.
For major problems with goods
You can:
• reject the goods and get a refund
• reject the goods and get an identical replacement, or one of similar value if reasonably available, or
• keep the goods and get compensation for the drop in value caused by the problem.
You get to choose, not the supplier or manufacturer.
I've previously posted about Scott - I had my Scale 50 (2008) crack in the rear chain stay.
It was almost 12 MONTHS LATER that I finally had this resoled in my favour and I was given a Scale 40 (2009) frame.
I own three Scott bikes (Scale, Genius & Sportster), for the record, their customer 'service' is not only pathetic, it's down right disrespectful to riders. Do you think I want a crack in my frame? Really?
If anyone that works at Scott lurks around this forum feel free to correct my experience, with examples of where you haven't jacked around customers (for months) about simple, obvious warranty repairs.

I bought the Genius and Speedster before I was jacked around. For the record, I think I'd still buy the SUB10 if I saw it at a good price.

I got my new frame back today had to pay for the parts to be swap over from old frame(scale 60) to new,i also had to deal with a advanti dealer who didn't sell me the bike,ive got no complaints with the service or the frame.According to advanti dealer they did a run of frames to cover warranties on scale and sportster frames as the new frame has scale 40 stickers but has hinges on frame for v brakes so not shore weather it is a true scale frame but im happy with it.Thanks for all the advice
